1. Copyright Policy
Systems to Scale Group respects the intellectual property rights of others and expects users of our websites, platforms, and services to do the same.
In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), including 17 U.S.C. § 512, Systems to Scale Group will respond to properly submitted notices alleging that material available through our websites or services infringes a copyright.
If you believe that copyrighted material you own or control is being infringed through a website or service operated by Systems to Scale Group, you may submit a written notification as described below.
2. DMCA Notice of Copyright Infringement
To submit a copyright infringement notice, please provide our Copyright Agent with a written communication containing substantially the following information:
Identification of the copyrighted work. Identify the copyrighted work that you believe has been infringed. If your notice concerns multiple copyrighted works on the same website, you may provide a representative list of those works.
Identification of the allegedly infringing material. Identify the material that you believe infringes your copyright and provide information reasonably sufficient to allow us to locate it. Whenever possible, include the specific URL or URLs where the material appears.
Your contact information. Provide information reasonably sufficient for us to contact you, including your name, mailing address, telephone number, and email address.
Good-faith statement. Include a statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, the copyright owner's agent, or the law.
Accuracy and authority statement. Include a statement that the information in your notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Signature. Include your physical or electronic signature.
Notices that do not contain sufficient information may delay our ability to investigate or respond.
3. What Happens After We Receive a Notice
Upon receiving a DMCA notice that substantially complies with applicable requirements, we may investigate the claim and remove or disable access to the material identified in the notice where appropriate.
Where the material was provided by a user or account holder, we may notify that person that the material has been removed or access to it has been disabled.
We may also provide the person who submitted the material with information contained in the infringement notice as reasonably necessary to administer the DMCA process.
Submitting a DMCA notice does not guarantee that material will be removed. We may request additional information where necessary to evaluate a claim.
4. Counter-Notification
If material that you submitted through our services has been removed or disabled as the result of a DMCA notice and you believe the removal resulted from a mistake or misidentification, you may submit a counter-notification to our Copyright Agent.
A counter-notification should contain your physical or electronic signature; identification of the material that was removed or disabled and the location where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification; and your name, address, and telephone number.
Your counter-notification must also include a statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g)(3) and that you will accept service of process from the person who submitted the original infringement notification or that person's agent.
If your address is outside the United States, the required jurisdictional statement must consent to the jurisdiction of any United States Federal District Court in which the service provider may be found, as provided by the DMCA.
5. Restoration of Material
If we receive a valid counter-notification, we may provide a copy to the person who submitted the original infringement notice.
Subject to the requirements of the DMCA, removed material may be restored or access reinstated not less than 10 and not more than 14 business days after receipt of a valid counter-notification unless our Copyright Agent receives notice that the person who submitted the original infringement notification has filed a court action seeking to restrain the allegedly infringing activity.
6. Repeat Infringers
Systems to Scale Group may, in appropriate circumstances, suspend or terminate accounts or access to our services belonging to users who repeatedly infringe the intellectual property rights of others.
We reserve the right to remove or disable access to content that we reasonably believe infringes intellectual property rights, whether or not we have received a formal DMCA notification.
7. Misrepresentations
The DMCA provides that a person who knowingly makes a material misrepresentation that material or activity is infringing, or that material was removed or disabled as the result of mistake or misidentification, may be liable for resulting damages, costs, and attorneys' fees.
Please consider whether the use complained of may be authorized by the copyright owner or permitted by law, including under principles such as fair use, before submitting a notice.
